These Terms of Service ("Terms") govern your access to and use of nettabenshabu.com (the "Site"), owned and operated by Netta BenShabu Elite Couture ("Netta BenShabu," "we," "our," or "us"), a company based in the State of California, United States. By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Site.

About the Site

The Site is an editorial showcase of the Netta BenShabu elite bridal couture line. It exists to present collections, share the atelier's story, and provide information about trunk shows and authorized boutique partners worldwide. Gowns are not sold directly through the Site. To purchase, schedule a fitting, or visit a trunk show, please contact us or one of our authorized boutiques.

Intellectual Property

All content on the Site — including but not limited to gown designs, photography, videos, illustrations, written copy, the "Netta BenShabu" name and logo, collection names, and the overall look and feel of the Site — is the exclusive property of Netta BenShabu Elite Couture or its licensors and is protected by applicable copyright, trademark, trade dress, and other intellectual property laws in the United States and internationally.

You may view and share Site content for personal, non-commercial purposes (for example, sharing a link or saving an inspiration image for your own wedding planning). You may not:

• Reproduce, republish, or redistribute Site content for commercial purposes;
• Use any Site imagery, designs, or marks to manufacture, advertise, or sell competing products;
• Remove, obscure, or alter any copyright notices, watermarks, or attributions;
• Frame the Site or otherwise present it in a misleading or deceptive manner;
• Use our brand name, logo, or collection imagery without prior written authorization.

Any unauthorized use may violate copyright, trademark, and other applicable laws and could result in legal action.

Acceptable Use

You agree not to use the Site to:

• Violate any applicable local, state, national, or international law or regulation, or the rights of any third party;
• Submit false, misleading, or fraudulent information through any form on the Site;
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity;
• Attempt to interfere with, probe, scan, or disrupt the Site, its servers, its underlying infrastructure, or other users' access to or use of the Site;
• Use automated means (such as scrapers, bots, crawlers, or data-mining tools) to copy, reproduce, or collect content from the Site without our prior written consent;
• Transmit any material that is unlawful, harmful, defamatory, obscene, or otherwise objectionable.

We reserve the right to terminate or restrict access to the Site for any user who violates these Terms, at our sole discretion and without notice.

Age Requirement

By accessing or using the Site or submitting any form, you represent and warrant that you are at least 18 years of age and legally capable of entering into binding agreements. If you are under 18, you may not use the Site.

Submissions and Contact Forms

When you submit information through a contact or registration form on the Site, you represent that the information provided is accurate and that you have the right to share it. We will use any information you submit only as described in our Privacy Policy.

We are not responsible for any failure of form delivery due to technical issues, spam filters, or other factors outside our control. If you do not receive a response within a reasonable time, please contact us directly at info@nettabenshabu.com.

Trunk Shows and Appointments

Trunk show schedules, locations, host boutiques, and availability are subject to change without notice. Submitting a registration form constitutes a request to be added to an event's invitation list and does not, by itself, confirm your attendance, a reserved fitting slot, or any contractual obligation on our part. A member of our team or the host boutique will follow up to confirm all details.

We are not responsible for any travel expenses, costs, or losses incurred in connection with attending or planning to attend a trunk show that is subsequently modified or cancelled.

Force Majeure. We shall not be liable for any delay, modification, or cancellation of trunk shows or any failure to perform our obligations under these Terms caused by circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, earthquakes, floods, fires, storms, pandemics or epidemics, acts of war or terrorism, cyberattacks, government actions or restrictions, civil unrest, strikes or labor disputes, power outages, or disruptions to internet or communications infrastructure. In such events, we will make reasonable efforts to communicate with registered attendees as promptly as practicable.

Boutique and Third-Party Information

The Site lists authorized boutique partners and their contact details as a convenience to visitors. While we make reasonable efforts to keep this information current, we do not warrant the accuracy, completeness, or timeliness of boutique listings, including hours of operation, inventory availability, addresses, or contact details. Boutique relationships and carrying status are subject to change.

We are not responsible for the products, services, policies, or practices of any authorized boutique or other third party. Purchasing a gown from an authorized retailer is a transaction between you and that retailer, governed by their own terms and policies.

Third-Party Links

The Site may contain links to third-party websites, including authorized boutiques, press features, and social media platforms. We do not control those sites and are not responsible for their content, privacy practices, or policies. The inclusion of any link does not imply our endorsement of the linked site. Visiting any third-party site is at your own risk.

Disclaimer of Warranties

The site and its content are provided on an "as is" and "as available" basis without warranties of any kind. To the fullest extent permitted by applicable law, Netta BenShabu disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components, or that any defects will be corrected. We do not warrant that the information presented on the Site is complete, accurate, or current at all times. Imagery is representative of the collections, and individual gown details, finishes, and availability may vary. We reserve the right to make corrections and changes to the Site at any time without notice.

Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Netta BenShabu, its owners, officers, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with: (a) your access to or use of (or inability to access or use) the Site; (b) any content or information obtained from the Site; (c) any transaction or relationship between you and any authorized boutique or third party; (d) any trunk show modification, cancellation, or scheduling change — even if we have been advised of the possibility of such damages.

Our total cumulative liability to you for any claims arising under or related to these Terms shall not exceed one hundred U.S. dollars ($100). Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless Netta BenShabu Elite Couture, its owners, officers, employees, agents, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of or access to the Site; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property or privacy rights; or (d) any content you submit through the Site.

Statute of Limitations

To the extent permitted by applicable law, any cause of action or claim you may have arising out of or relating to these Terms or your use of the Site must be commenced within one (1) year after the cause of action accrues. After that one-year period, such cause of action or claim is permanently barred.

Dispute Resolution

Informal Resolution. Before filing any formal legal claim, you agree to first contact us at info@nettabenshabu.com and attempt to resolve the dispute informally. We will attempt to resolve any dispute within 30 days.

Binding Arbitration. If the dispute cannot be resolved informally, you and Netta BenShabu agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Site shall be resolved by binding individual arbitration administered by JAMS (or a mutually agreed alternative arbitration provider) in Los Angeles County, California, under its then-current rules. Judgment on any arbitration award may be entered in any court of competent jurisdiction.

Class Action Waiver. To the extent permitted by law, you and Netta BenShabu waive any right to pursue disputes on a class, consolidated, or representative basis. All disputes must be brought in the parties' individual capacities.

Exceptions. Either party may seek emergency injunctive or other equitable relief in any court of competent jurisdiction to prevent actual or threatened infringement of intellectual property rights or other irreparable harm.

Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of laws principles. For any matters not subject to arbitration, you consent to the exclusive jurisdiction of the state and federal courts located in Los Angeles County, California, and waive any objection to such jurisdiction or venue.

Changes to These Terms

We may update these Terms from time to time at our sole discretion. The "Last updated" date at the top of this page will reflect the most recent revision. If we make material changes, we will make reasonable efforts to notify users (such as by posting a notice on the Site). Your continued use of the Site after the effective date of any updated Terms constitutes your acceptance of those changes. If you do not agree to any updated Terms, you must stop using the Site.

Severability and Waiver

If any provision of these Terms is found to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Netta BenShabu Elite Couture with respect to your use of the Site and supersede all prior or contemporaneous understandings, agreements, representations, or communications on that subject.
